EMCQPractice Pty Ltd. (“EMCQPractice” or “we”) provides the content posted on the EMCQPractice.com.au website to you (“You” or “user” or any person or entity or similar) subject to the following Terms of Use. Please read these Terms of Use carefully. By using our site you indicate your acceptance of these terms of use and that you agree to abide by them. If you do not agree with these Terms of Use, please do not use the EMCQPractice Website.

COPYRIGHT:

The EMCQPractice Website, including the text, graphics, and software (collectively, “Content”) that appear on the EMCQPractice Website, is owned by or licensed to EMCQPractice, and is protected by copyright and other intellectual property rights under Australia, foreign laws and international conventions. Some images appearing on the website are from Wikipedia which are either in public domain or covered with creative common 2.5,3 or 4 licenses.

YOU MAY NOT SHARE, PUBLICLY DISPLAY, RE-POST, MODIFY, COPY, REPRODUCE, REPUBLISH, UPLOAD, POST, TRANSMIT, OR DISTRIBUTE, IN ANY MANNER, THE CONTENT ON OUR SITE, INCLUDING TEXT, GRAPHICS, CODE AND/OR SOFTWARE. You cannot sell, re-sell the content on our site to third parties, or prepare derivative works of the content on our site.

USER OBLIGATIONS:

You must use the website for lawful purposes only. You must not use the website in any way that causes or is likely to cause the website or access to it to be interrupted, damaged or impaired in any way. You may not use any “deep-link”, “page-scrape”, “robot”, “spider” or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Site or any Content, or in any way reproduce or circumvent the navigational structure or presentation of the Site or any Content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Site. EMCQPractice reserves the right to bar any such activity. EMCQPractice monitors such activity and any accounts from which such activity has originated or generated will be terminated immediately and appropriate course of action taken.

MODIFICATIONS:

EMCQPractice may modify these Terms of Use from time to time and changes will be effective upon posting to the EMCQPractice website. You agree to be bound by any modification of these Terms of Use when you use the EMCQPractice website, effective after their posting to the EMCQPractice Website. It is therefore important that you review these Terms of Use regularly to ensure you are updated as to any changes.

SUBSCRIPTION TERMS & CONDITIONS

EMCQPractice Pty Ltd. (“EMCQPractice” or “we”) provides the content posted on the EMCQPractice.com.au website to you (“You” or “user” or “subscriber”) subject to the following Subscription Terms & Conditions and EMCQPractice website Terms of Use. Please read these Terms of Subscription carefully. By using our subscription products and/or services you indicate your acceptance of these terms and that you agree to abide by them. If you do not agree with these Terms of Subscription, please do not subscribe to the EMCQPractice Website.

SUBSCRIBER OBLIGATIONS:

Before you can subscribe to EMCQPractice’s website products you agree to complete the registration process by providing current, complete, and accurate information as required by EMCQPractice to create an user account. If you have registered or subscribed to use any service within the Website, any user identification code or password is personal and non-transferable and must be kept confidential and used only by you.  You are responsible for all activities that occur under your account. You agree to notify EMCQPractice immediately of any unauthorised use of your account or any other breach of security. EMCQPractice will not be liable for any loss that you may incur as a result of someone else using your account, either with or without your knowledge. In addition, you may be held liable for any losses incurred by EMCQPractice or another party due to someone else using your account. You may not use anyone else’s account at any time.

PRODUCT ACCESS:

Product access is available as soon as your full payment for the product access is processed. You’ll be charged the rate stated at the time of purchase. Should you cancel your service, your payment is non-refundable. Please contact info@emcqpractice.com.au if you wish to cancel your product access.

PRODUCT ACCESS EXPIRY:

Once product access is available, it is ready to be accessed anytime for 6 months from the date the payment is processed.

You need to access the product for you to see and interact with the content. The exam mode is limited to one attempt only. The countdown timer and the exam cannot be paused once you enter the exam mode of the practice exam. The time limit for exam mode is as per the countdown timer. After termination of exam mode, review mode is ready to be accessed any number of times until product access expires.

Unless allowed or stated otherwise, re-attempt of the same practice exam is only by re-purchasing the product access as outlined above.

DEFINITIONS & INTERPRETATION:

“We”, “Us” – means EMCQPractice Pty LTD ABN 35 613 682 232

“You”, “User”, “Subscriber” – a natural person of age 18 years and over and able to provide informed consent and informed financial consent.

“Product”, “Service”, “Practice Exam” – Interactive informational content available through the learning management software system on EMCQPractice website.

“Subscription”, “Purchase of Subscription”, “Purchase of Product” – “Purchase” does not explicitly or implicitly imply transfer of ownership of any or part thereof, of the intellectual property, informational content, idea or code of software. Subscription only allows for temporary access to content as per the Subscription Terms & Conditions. This content is protected by copyright and intellectual property rights as per EMCQPractice website Terms of Use.

“Exam mode” – The first section of the practice exam. Exam mode commences after you click “(Start my Exam Now)”. Exam mode terminates when the time limit is reached or at any time if you choose to terminate, whichever is earlier.

“Review mode” – The second section of the practice exam. Review mode commences after the termination of Exam mode. Review mode terminates when the product access expires or at any time if you choose to terminate your access, whichever is earlier.

PRIVACY POLICY 

EMCQ Practice regards customer privacy as an important part of our relationship with our customers. The following privacy policy applies to all EMCQPractice users, and conforms to Internet privacy standards. COLLECTION OF INFORMATION:

In order to use the EMCQPractice website, we may require information from you in order to provide the best service possible. All correspondence may also be collected and stored, particularly in regard to sales, support and accounts, including Email. Any information collected by EMCQPractice is collected via correspondence from you or your company. This may be via telephone, Email, mail, fax or directly through our website.

USE OF COLLECTED INFORMATION:

Any details collected from EMCQPractice customers is required in order to provide you with our products and/or services, and a high level of customer service. Correspondence is recorded in order to provide service references, and to assist in our staff development.

STORAGE OF COLLECTED INFORMATION:

The security of your personal information is important to us. When you enter sensitive information (such as credit card numbers) on our website, we encrypt that information using secure socket layer technology (SSL). When Credit Card details are collected, we simply pass them on in order to be processed as required. We never permanently store complete Credit Card details. We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. ACCESS TO COLLECTED INFORMATION:

ORDERS:

If you purchase a product or service from us, we may request certain personally identifiable information from you. You may be required to provide contact information (such as name, Email, and postal address) and financial information (such as credit card number and expiration date). We use this information for billing purposes and to fill your orders. If we have trouble processing an order, we will use this information to contact you.

COMMUNICATIONS:

EMCQPractice uses personally identifiable information for essential communications, such as Emails, accounts information, and critical service details. We may also use this information for other purposes, including some promotional Emails. If at any time a customer wishes not to receive such correspondence, they can request to be removed from any mailing lists by emailing us at info@emcqpractice.com.au. You will be notified when any third party that is not our agent/service provider collects your personal information, so you can make an informed choice as to whether or not to share your information with that party.

THIRD PARTIES:

EMCQPractice may at its discretion use other third parties to provide essential services on our site or for our business processes. We may share your details as necessary for the third party to provide that service. These third parties are prohibited from using your personally identifiable information for any other purpose. EMCQPractice does not share any information with third parties for any unknown or unrelated uses.

LEGAL:

We reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, or legal process served on our Website.

Links on the EMCQPractice site to external entities are not covered within this policy. The terms and conditions set out in this privacy statement only cover the domain name of www.emcqpractice.com.au

SECURITY POLICY

TRANSACTIONS:

PRICING & PURCHASE:

The price that you pay for the services you order should be the standard pricing as indicated on the website. All prices are quoted in Australian Dollars(AUD). These prices are inclusive of all taxes and delivery unless otherwise indicated. International payments and transactions attract currency exchange rate and other transactional fees as charged by your bank, credit provider and stripe.

DISCOUNTS & COUPONS:

Discounts are incorporated for products that are purchased as a “bundle”. No refund provided for products purchased at a discount. Some promotional offers may not be combined with other offers in the same order. We reserve the right to vary these discounts, and the applicable terms and conditions at any time.

DELIVERY POLICY:

After ordering online, you will receive an email confirmation from us containing your order details. You will have instant access to the content from your “My Exams” section. We will normally confirm receipt of your order within a few minutes of ordering.

REFUND POLICY

All refunds are considered at the discretion of EMCQPractice executive. No refunds are offered to any product on EMCQPractice website that have been used, accessed or viewed online. Our product is online educational content available via subscription and bound by our Subscription Terms & Conditions.

Please email us at info@emcqpractice.com.au if you believe you have an exceptional circumstance with your purchase so that we can resolve any problems. In exceptional circumstances where a refund is warranted, the amount refunded is less the applicable administrative charges.

No refunds are offered if you made an error in your purchase, products purchased using a discount coupon, you had a change of mind or change in your circumstances, your access to educational content was interrupted due to any reason whether or not such reason could have been anticipated or unforeseen.

DISCLAIMER

The Australasian College for Emergency Medicine (ACEM) has recently changed the format of the Primary and Fellowship examinations. With the information available, EMCQPractice has interpreted the ACEM College instructions to produce newly formatted Multiple Choice Questions (MCQs).

All reasonable care has been taken to provide questions of ACEM examination quality and standard. EMCQPractice aims to aid candidates in their preparation for the Primary and Fellowship examination. However, using content provided by EMCQPractice does not guarantee success in the ACEM Primary or Fellowship examinations, and EMCQPractice will not be held liable for candidates who are unsuccessful in the ACEM Primary or Fellowship examination.

We recommend using the content provided by EMCQPractice in combination with the teaching program at the hospital you are based in, as well as the recommended textbooks and resources as listed by ACEM. We have attempted to ensure information is accurate and up to date. Users of this material should confirm that the information contained within is correct by way of independent sources.
